RE: The tariff classification of a “Beaded Ombre Pillow Cover” from India

Dear Ms. Chan:

In your letter dated January 23, 2013, you requested a tariff classification ruling for sku #726232 and #726869. However, only one sample was submitted. In a telephone conversation with this office, you stated that the representative sample you submitted for our examination was sku #726232. This ruling request will only address sku #726232.

In your letter, you described the product under consideration as a “Beaded Ombre Pillow Cover”.

The pillow cover is composed of 100% cotton jersey knitted fabric (ombre dyed) and 85% cotton/15% linen woven fabric. The front panel (cotton jersey knit fabric) is layered with a 100% polyester woven net fabric, cut to size. The face of the article is largely covered with small glass pieces sewn directly onto the net fabric. The back panel (cotton/linen fabric) features a full width opening with a zipper. The item measures approximately 17 inches x 17 inches. The essential character of this article is imparted by the glass component.

The applicable subheading for the pillow cover largely covered with small glass pieces will be 7018.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glass beads, imitation pearls, imitation precious or semiprecious stones and similar glass smallwares and articles thereof other than imitation jewelry…other: other. The rate of duty will be 6.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
